Policies and Agreements
This policy covers how we use your personal information. We take your privacy seriously and will take all measures to protect your personal information. Any personal information received will only be used to fulfill your order, and may be used for internal analytical purposes. We will not sell or redistribute your information to anyone.
2.Pass Guarantee Policy
To qualify for the pass guarantee, you must meet the following criteria:
a. You must attend the entire course.
b. You must send post-exam assessment reports within ten (10) business days of failing the exam. If you fail to pass your exam a total of three (3) times within 120 calendar days following completion of the course, we will refund in full your tuition.
c. Above-described refunds will be sent via a paper check mailed to the student within thirty (30) days after PMEC receives proof of the third exam failure. Under no circumstances shall the amount refunded be greater than the amount paid for the course.
3. Registration and Payment
a. Your course purchase from us is non-refundable once you receive the course materials. You may transfer your registration for a live training course to a future date on which the course if offered, provided that you notify us of your request at least ten (10) business days prior to the start date for your registered course.
b. If you disrupt a course session, we reserve the right to remove you from the course. In the event you are removed from a course, you will have no right to a refund.
c. All transfer, cancellation, and refund requests must be made in writing via email. In the event that we elect in our discretion to refund a course fee paid by you, the refunded amount will be credited to the credit card that you used for the purchase or a check will be mailed to the your billing address within ten (10) business days after the request is approved.
a. PMEC does not Guarantee, represent, or warrant that the use of our services will be uninterrupted or error-free. Our products and services are provided “AS IS” and for your use, without warranties of any kind either express or implied.
b. We do not Guarantee or warrant your eligibility to sit for any exams, as the governing bodies of such exams have that authority at their sole discretion, and make such determinations.
5. Limitation of Liability
a. In no event shall we be liable to you for indirect, special, punitive, incidental, reliance, exemplary, or consequential damages (whether loss of profits, loss of expected savings, or otherwise). In no circumstance shall our total liability to you exceed the amounts paid by you to PMEC for course enrollment.
b. The foregoing limitations of liability and disclaimers apply regardless of the form of the action, whether sounding in contract, warranty, strict liability, negligence, or other tort. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, our liability in such jurisdictions shall be limited to the extent permitted by law.
6. Our Copyrights
PMEC, INC owns copyrights for instructional materials that you receive from us. You are granted a personal use license for the instructional materials, for the sole purpose of training you in the curriculum for the course(s) that you purchase from us.
This purchase agreement is between you (the “purchaser” or “student”) and PMEC, INC, dba PMEC.
8. Governing Law
a.PMEC is an Arizona Company. This Agreement and your use of our website and services are governed by and construed in accordance with the substantive law of the State of Arizona.
b. PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS. any dispute or claim relating in any way to your use of any service, or to any products or services sold or distributed by PMEC INC or through pmexam.com will be resolved by binding arbitration, rather than in court.
